1. Introduction

  1. These terms and conditions govern Our access to and use of the website luckyvegas.com (the “Site”), including mobile and tablet apps that We own or operate through which You access the Site (the “Agreement”). By visiting the Site, You acknowledge (a) this Agreement, (b) Our Privacy Policy, (c) Our Cookie Policy, (d) the (individual) rules applicable to Our products offered on the Site (the “Game Rules”) and (e) any other rules applicable to Our promotions or bonuses available on the Site from time to time.

  3. The Site is operated by Skill on Net Ltd, a company registered in Malta under Reg. No. C50024 with its business address at Office1/5297, Level G Quantum House 75 Abate Rigord Street, Ta' Xbiex 1120 Malta, operating under a gambling license issued by the Kansspelautoriteit (http://www.kanspelautoriteit.nl) with license number [insert remote gambling license number].
  4. In this Agreement, Skill on Net Ltd is referred to as “Skill On Net”, “We", “Us”, “Our” or some other name of similar purport, and You as the “Customer”, “You”, “Your”, “Player”, or by some other term of the same purpose, and jointly as the “Parties”, or individually as a “Party”.
  5. We consider this Agreement to be fair. Should You need any advice regarding the terms in this Agreement, or any other rules, policies applicable to Our service available on the Site from time to time, in Your own and Our interests, please contact Us via Our Customer Services Department at support@luckyvegas.com 
  6. By ticking the relevant box when You register an account on the Site, You explicitly accept, agree with, and will comply with, this Agreement and the Game Rules (hereinafter collectively referred to as the “Terms”) and You thereby enter into a legally binding agreement between You and Us. We ask you to not visit, access or make use of any part of the Site if You do not accept or agree with the Terms. Once You have accepted these Terms, Your failure to comply with any one or more of them may result in disqualification, account closure, and/or legal action against You. Please note that our Privacy Policy and Cookie Policy are provided herein for informational purposes only.
  7. Without prejudice to the fact that You are only allowed to register one account on the Site, if We have reasonable grounds to suspect or identify that any two or more registered accounts are linked including whether they are linked to the same internet protocol (“IP”) address, pattern of use, proximity of transactions, common bank details or address in common or otherwise and that the services provided via the Site are being abused of by You in any way, including by way of example due to a previously undetected fault, bug or other fault in the software, We may suspend the services provided to You via the Site and Your ability to access Your account(s) with immediate effect as well as to reverse transactions on any one or more of the accounts that are linked.
  8. This Agreement is written in Dutch. If this Agreement is translated into another language, the Dutch version will prevail.
  9. Unless otherwise stated a fee or charge displayed in this document is in euros (“EUR”).
  10. We reserve the right to restrict access to all or certain parts of the Site in respect of certain jurisdictions.
  11. Unless stated otherwise, whenever a time is mentioned, it refers to Central European Time (CET) or Central European Summer Time (CEST) when Daylight Saving Time is in force.
  12. We reserve the right to limit/refuse bets at any time and for any reason.
  13. We reserve the right to adjust the minimum/maximum bets within the casino at any time and for any reason.
  14. In these terms, whenever reference is made to a Balance this may refer to Real Money balance or OJO Plus balance, or both.
  15. We believe in Fair Play, hence there are no wagering requirements on any of our rewards or offers. Since we are fair, we expect you to be too, and in order to guide you on our expectations we have prepared the following Fair Play Policy. Any internal investigation which uncovers noncompliance of this Fair Play Policy, which will be determined by Us in Our sole opinion, may result in the removal of funds from your balance, suspension of any current or future Reward or closure of your account and refusal of any of your future accounts. Any of the below patterns and behaviors are considered Anti Fair Play.

    1. Accruing OJO Plus or Unlocking Levels and receiving OJO Wheel Rewards by using low risk betting patterns (low margin betting, equal betting, zero risk bets, hedge betting, doubling systems. For the avoidance of doubt this includes using low risk betting patterns either alone or by colluding with others, either on this site or with one party on this site and another party on a different site.

    2. Depositing purely to take advantage our Rewards/Offers and with no intention of playing /risking the funds you deposited with.

    3. Colluding in any way with others in order to take advantage of Rewards or offers.
  16. The only approved way to send verification documents is via the Upload Docs page in My Account/Personal Area. Documents received by any other avenue will not be accepted.
  17. During your time as a customer You may be required to upload documentation proving your ID, registered address and ownership of certain deposit methods. For example, when certain thresholds are reached or prior to allowing a withdrawal to be processed. We encourage you to upload these documents as early as possible to avoid an uninterrupted experience.
  18. At our sole discretion, in order to adhere to Anti Money Laundering and Responsible Gambling obligations, we may suspend any player’s ability to deposit and/or withdraw and/or play as a result of any required customer account checks. We may investigate a player’s identity, personal history, occupation, financial standing/Source of Funds and/or gaming activity. In any case, following an account/player activity assessment, if serious concerns are raised in relation to Responsible Gambling and/or Player Safety warranting an immediate restriction of the account from further play, any deposited funds still available on the account will be available for withdrawal and or returned to the player (whenever this is deemed necessary) including funds deposited for currently active bonuses on the account.
  19. You hereby acknowledge that by betting you risk losing money.
  20. You hereby acknowledge that you know it is unlawful to deposit money derived from ill-gotten means and you will not use any such funds in conjunction with your depositing and gambling on this website/application.
  21. If you are required to provide documentation as described in any Section of this agreement and you have failed to comply, your Account may be suspended until such documentation is received and a review completed.

2. Account Registration

  1. The following persons are prohibited from registering an account. (i) be a shareholder or participant in our share capital, (ii) a director or employee of ours. If any such accounts are identified they will be suspended and all funds confiscated.
  2. You must be at least 18 years of age to use the services offered via our Site, Please be aware that underage gambling is illegal.
  3. Prior to being able to use our services, you must register an account by providing:
    1. BSN number
    2. First name
    3. Last name
    4. Date of birth
    5. Place of Birth
    6. Address
    7. City
    8. Zip Code
    9. Username.
    10. Password
    11. Mobile number (You will have to verify the mobile phone number provided by inputting a onetime password we send to it)
    12. Email
    13. A limit on your deposits and time
    14. A ‘maximum balance’, above which all amounts will be credited to your ‘Contra Account’
  4. Following providing the registration information in 2.2 it will be verified using a service provided by the KSA (CRUKS) for validity. Only a valid combination of Names and date of birth will pass this verification.
  5. Following the verification in 2.4, we will one way encrypt and delete the BSN you provided during registration and also consult the national database of self excluded persons. If you are on the national register of self excluded persons your attempt to register will be suspended and you can return when you are no longer on the national register of self excluded persons.
  6. Following successfully passing clauses 2.5 we will then request you to set up your ‘Contra Account’ which is a bank account which must be in your name, to which we will pay withdrawals to (subject to clauses X in the withdrawal section) . We will do this using a service that allows you to log into your online bank account and transfer an amount of €0.01 to us. You cannot pass this stage of registration unless you €0.01 to us from a bank account in your name. The €0.01 transfer is non refundable and will not be added to your balance if you complete the registration and verification process.
  7. Following successful set up of your Contra Account, as a final step of verification we will ask you to upload an official photo ID document from the accepted list below.
    1. A valid passport (Dutch or foreign)
    2. A valid Dutch identity card (or one issued by the competent authority in another Member State, including a passport photograph and name of the holder)
    3. A valid Dutch driving licence (or one issued by the competent authority in another Member State, including a passport photograph and name of the holder)
    4. Travel documents for refugees and aliens, aliens’ documents issued under the Aliens Act 2000

      The name of the document must match exactly the name you registered with. You cannot pass this final stage of registration unless you upload a valid ID document with your name on it.   
  8. You agree to keep the details on record updated to your most recent information by updating any items that change.
  9. It is strictly prohibited to open an account or conduct a transaction on behalf of a third party, or to allow any third party access to your account.
  10. You are not allowed to register more than one account. This means only one account is allowed to be registered per BSN number. Any attempt to try and deceive Us by registering multiple accounts in another username to gain bonus money will be deemed as abuse and will result in the account(s) being suspended, bonus money being removed, winnings voided and the option to withdraw monies cancelled.
  11. Upon registering an account and accepting the Terms, You hereby acknowledge, guarantee, and explicitly declare that:
    1. You are legally competent and will only play for Your own account;
    2. Your participation in the Games is at Your sole discretion and risk and that We are unable to provide You with any legal advice or assist You with any Legal queries related to the legality of participation in remote gambling;
    3. Your registration or account will not be used for money laundering or the financing of terrorism, for the violation of sanction orders or for fraud with or misuse of our games;
    4. You will take due care with the means of identification for login, take all reasonable measures to prevent its use by third parties and, to this end, will comply with any further instructions to be drawn up by Us.
    5. You have taken note of:
      1. Our remote gambling license, geographical address, contact details and the contact details of Customer Support, as referred to in this Agreement.
      2. That there are, other than the stake required for the games offered and the costs for the use of the technique of the games, such as the rake for poker and the commission for offering bets (insofar applicable, this information can be found in the respective Game Rules), no fees, costs, expenses or taxes associated with taking part in Our games, unless otherwise specifically indicated to the contrary;
      3. The games that we organize, including the specific characteristics (if any), the respective Game Rules, winning chances, method(s) used to determine chances and, insofar as this is possible, pay-out percentages (insofar applicable, this information can be found on the Site);
      4. The categories of individuals who cannot make use of our games, as referred to in this Agreement;
      5. Our Customer Complaint procedure, as referred to in this Agreement;
      6. Our Privacy Policy as well as the policy for the prevention of criminality related to Our games; and
      7. Our Responsible Gambling page, including in any case information on the risks of gambling addiction, the registration and analysis of gaming behaviour, our addiction prevention policy, addiction care (institutions) available in the Netherlands, anonymous help and facilities available in this regard, self-exclusion from using our services and registration in the Central Exclusion Register (Centraal Register Uitsluiting Kansspelen).

3. Information We Collect About You and How We Use It

  1. We process information about You in accordance with the applicable data protection laws. Please refer to Our Privacy Policy which amongst others contains details on Your data protection rights, the types of information We collect, what We do with that information and to who it may be shared with and why.
  2. We are entitled to share the information We hold on You, which includes personal data and gaming history with regulators, and other bodies, including the police, and law enforcement bodies in order to investigate fraud, money laundering gaming integrity issues and to comply with Our regulatory duties, provided of course that Your rights under the applicable data protection laws are honored.
  3. Please note that You may at any time lodge a complaint with a supervisory authority concerning Our processing of Your personal data.

 4. Grant of License

  1. The Site runs on a series of programs which are either proprietary to Us or are licensed through third parties to be able to offer You Our services through the Site (the “Software”).
  2. We grant You a license to use a single copy of the Software and where applicable the related documentation solely in accordance with and subject to this Agreement and applicable laws and regulations. You acknowledge and agree to not intentionally harm, infringe or misuse the Software in any way.
  3. You may neither sell, rent, lease, transfer or grant any other right of the Software, nor reverse engineer, copy, decompile, or dissemble the Software in any way, except as otherwise expressly permitted in this Agreement.
  4. You may not disclose the Software to any third party, make derivative works based upon it, or use it for any purpose except for the specific uses expressly permitted in the Player documentation, which accompanies the Software.
  5. The Software is available to You on an "As Is" basis only and without any warranty or indemnity of any kind. The download and/or use of the Software and services is at Your own risk.
  6. You hereby acknowledge that how You use the Software is outside of Our control. We shall not be liable to You or to any third party in respect of Your receipt of and/or use of the Software other than in cases of willful intent or gross negligence on Our part.

5. Real Money Mode and Try for Free Mode

  1. By using the services offered through our Site, You will be able to play in either the 'Real Money'mode or 'Try for Free'.
  2. In 'Real Money'mode, real money is used. In order to play in 'Real Money' mode You are required to have free spins, or funds in Your balance, or pay funds into Your account (which has the meaning described in clause 7) by any of the methods specified from time to time by Us. Such funds will be deposited into Your account upon actual receipt of funds or upon receipt of approval from a payment processor. We are not a bank and funds are not insured by any government agency. All payments to and from your account must be paid in the currencies listed in the cashier from time to time and shall not bear interest. All payments into Your account must be from a payment source on which You are the named account holder. Please note that We do not allow a negative balance on Your account and it is not possible to play games if the positive balance on Your account is insufficient for this. We have taken appropriate measures for the separation of Player funds from Our risk-bearing capital, as required by applicable law and further defined in clause 32 of this Agreement.
  3. In 'Try for Free'mode, no real money is used. Funds played in 'Try for Free' mode have no value in and of themselves and are kept separate from Real Money funds. Neither funds nor any game features (for example, but not limited to Multipliers, Bonus games and Bonus Points) are transferable to a Real Money account nor are they redeemable for any currency. If any game features are incorrectly transferred from Try for Free Mode to Real Mode any winnings derived will be removed. If You notice the transfer of any game feature from Try for Free Mode to Real Mode it is Your responsibility to inform Us immediately. Try for Free Mode can be accessed per game (if available for that game) by choosing to ‘Try For Free’ on the game icon. Once you close the game, you are no longer in Try for Free Mode.
  4. It is not advisable to play 'Real Money'mode before trying 'Try for Free' We recommend players practice in 'Try for Free' mode prior to playing in 'Real Money' mode.
  5. It is Your responsibility to make sure that you read and understand all the Game Rules and procedures of the games on the Site(s) prior to playing real money games. Please refer to clause 1.2 of this Agreement as to where You can view and download the Game Rules.
  6. You hereby acknowledge and agree that using Our services might result in losing monies and that all losses incurred will be Your sole responsibility.
  7. The games Return-to-player percentage (the “RTP”) is displayed in the Game Rules within each game and is subject to change. If the RTP is an important factor in Your decision whether to play a particular game We recommend checking the game rules each time You play.

6. Player Accounts

  1. Your Account is for your personal use only. You may not divulge Your Account details to anyone else or use anyone else account details.
  2. Any use of Your Account is strictly for your own private purposes. You shall be solely responsible for all transactions conducted in relation to your account using your Username and Password. Every person who identifies himself/herself by entering Your correct Username and Password or logs into Your account using biometric login functions is assumed by Us to be You and all transactions where the Username and Password have been entered correctly will be regarded as valid and authorized by You.
  3. We take absolutely no responsibility for any third party accessing Your Account using the correct Username and password and we shall not be liable for any losses incurred by you as a result of such an event. Any access to Your Account with the correct Username and password will be considered by us as valid.
  4. Should you become aware of any unauthorized use of Your Account, you are obliged to immediately notify us and we will suspend your Account pending further investigation of such unauthorised use. To help prevent un-authorized account use, We recommend that you do not use any functionality which saves your password for you.
  5. Your account is not a banking facility. Deposits should only be made with a view to using funds to place bets. Should You make repeated deposits and withdrawals without placing a commensurate amount of bets, or placing all low or very low risk bets, we reserve the right to pass on to your accounts, without prior notice, any bank charges (15% of the amount) we have incurred before closing the account.
  6. Account facilities are provided to You solely to enable you to place bets or participate in games. If you, for whatever reason, appear to be depositing or withdrawing money without genuine play, you will be liable to have your account suspended and the circumstances investigated. This may result in a report to the necessary authorities and/or the account being closed.
  7. If you wish to deactivate your account, please contact the customer support department who will expedite your request. If your request to deactivate your account is due to you not being able to control your gambling, please immediately use the account restriction features available via the Player Limitation page. Please note that upon deactivation of your account:
    1. You will no longer be able to login
    2. If you wish to play with us again, you will have to register a new account
  8. You hereby confirm that you are not using or intending to use or intending to allow any other person to use your account in relation to Our services for any prohibited or unlawful activity, including but not limited to, fraud or money laundering, under the laws of your jurisdiction or any other applicable laws in any other jurisdiction.
  9. You hereby confirm that You have not held a Player Account with Us that was terminated or suspended, and You have not notified Us, now or in the past, that You have a gambling addiction.
  10. You hereby confirm that You shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to Your or third parties' participation in any of the Games.
  11. You agree that if, in Our opinion, if any suspicious, improper, fraudulent, or unlawful activities are attempted and/or performed through the use of Our Services, We will be entitled to terminate and/or block your account and seize all funds available through that account. We also reserve the right to disclose any and all details of your account to the relevant authorities.
  12. In the event that you become aware that another Player of Our services is cheating, manipulating or attempting to manipulate game outcomes and results, colluding with any other person in order to defraud Us, using Artificial Intelligence Software, or doing anything which can be construed as detrimental to us, financial or otherwise, You are responsible for sharing such information with us. We will treat any such information You pass to Us in the strictest of confidence. In the event that we discover, or suspect, that you had such knowledge and did not pass it on to Us, we reserve the right to terminate Our services to You and confiscate any funds which are in Your account.
  13. We reserve the right to under certain conditions (as described in this Agreement) terminate Your account. When Your account is terminated, We will promptly and without unnecessary delay pay out the balance on the player account to You. However, We will only pay back that which remains of the deposits made by You if Your account is terminated because You have been excluded from gambling as a result of misconduct. If We terminate your account, We will inform You in writing thereof and of the reasons for the decision.
  14. Please note that information regarding Your player profile and account, including but not limited to the current balance, the initial balance in the Your account on last login, total stake since last login, the total winnings and the total losses since last login and an overview of all transactions in the account during the last ninety (90) days, is available in my account section in the casino software.
  15. Without prejudice to Our obligation to verify the relevant information before completion of Your registration, We reserve the right any time thereafter to request additional documents from You to verify a) Your identity and physical address; b) Your bank, debit or credit card details and c) Your source of funds. You agree to comply with such requests in a timely manner and understand that failure to do so may result in suspension of Your account and reporting any suspicious activity in line with applicable legislation. 
  16. You may impose self-restrictions on Your account and Your access to Our services by utilizing our Player Limitation services, as set out in paragraph 20.7 of this Agreement. In case the reason behind the closure of the account is related to concerns about possible gambling addiction or you wish to extend the limitation period, You shall inform us via email after placing your limitation.
  17. In line with our Addiction Prevention Policy, if we suspect your gambling is causing harm we reserve the right to suspend your account and request permission from the KSA to add you involuntarily to the register of self excluded players. This suspension can last up to 6 months due to the legal time allowed to the KSA to respond.
  18. If you no longer meet the requirements for registration we will suspend/terminate your account and where necessary conduct an investigation as to why you no longer meet the requirements.
  19. Regardless of your account being suspended, you can either login or contact the customer support department to access any information about your account.

7. Transactions: Deposits

  1. Unless otherwise stated in the relevant casino pages of the Site, the minimum deposit is €10.
  2. Deposits are only allowed from the Current Account (mandatory for the initial deposit) or from every other payment instrument (for every subsequent deposit) on Your name. After each deposit, You will receive email confirmation of the transaction. We recommend that You print out and keeps details of all transaction data in order to avoid misconceptions and discussions at a later time.
  3. All deposits will be effective immediately as soon as We get a successful confirmation from the selected payment processor (except for Wire Transfer Deposits).
  4. Please note that documentation in the form of ID, utility bill/statement or copies of the front of Your credit- or debit card may be required in connection with any deposit in accordance with Our Know-Your-Customer (“KYC”) procedures.
  5. We reserve the right to contact You to verbally or textually verify any deposit made.
  6. We reserve the right to void all winnings if Your name does not match the name on the credit or debit card You use. In such circumstances We reserve the right to request the necessary documentation from You to enable Us to carry out the required identity verification checks from Our end, prior to taking any action.
  7. No charge-backs can be made or initiated by you. In addition, payments including deposits made to Your account using any payment method/source cannot be renounced, cancelled, disputed for no valid reason or otherwise reversed. If this happens We reserve the right to take any of the following actions or request You to take immediate action, whichever the case may be, as a necessary measure to safeguard Us against possible fraudulent activity or any other form of abuse:
    1. You shall immediately and without undue delay refund the total amount due to Us and compensate Us for any and all unpaid amounts due to Us including any expenses or charges We might incur in the process of recovering the amount due.
    2. Should You initiate a chargeback, We reserve the right to terminate your account, initiate legal proceedings to recover the funds You are trying to chargeback as well as any charges or expenses which We might incur as a result and report the matter to the relevant authorities, including but not limited to the police, if We suspect foul play.
    3. We reserve the right to recuperate the total amount due to Us from Your balance.

      We reserve the right to terminate your account at any time without any prior notification. If we terminate Your account, we will inform You in writing thereof and of the reasons for the decision.

  8. We may, at any time, set off any positive balance on your account, or connected Account, against any amounts owed by You to Us.
  9. In the case that there is a processing charge for your deposit You will be clearly informed about it during the deposit process.
  10. If we detect that funds were deposited with a payment method not belonging to the same person who registered the casino account the funds deposited with not be available for playing and also any refund made will be minus any processing costs.

 

8. Transactions: Withdrawals

  1. Withdrawals will only be processed if a Player has a Real Money Account (i.e. made at least one successful deposit from his Current Account), with sufficient real money balance for the withdrawal. Withdrawals will be remitted only to Current Account and not to any other method used for deposits, including but not limited to credit cards.
  2. Withdrawals can only be made based upon relevant available information provided by the Player.
  3. In order to allow us to pay withdrawals without unnecessary delay, on account registration our system applies controls that include an individual withdrawal amount per transaction. This amount is displayed in the ‘more info’ section on the withdrawal page. After a transaction is processed you can immediately request another one. There is no limit to the number of transactions per day/week/month.
  4. Please also note that if there is a large win (€5000 or more), or jackpot win it may take longer to process the request in order to verify the win (with a third party where relevant) and to complete all required identity- and verification checks.
  5. Any payments of funds made to you from Us may be subject to a surcharge to cover costs, such as in the case of wire transfers, which We will deduct from Your balance before processing the withdrawal.
  6. Transfer of funds between players is strictly forbidden.
  7. We aim to process all withdrawals without unnecessary delay and in order to help make this goal We recommend that You send Us/upload any necessary documentation so as not to delay the process. You may modify or reverse your request to withdraw funds at any time until Your withdrawal has been completed and fully processed at which point Your funds will be returned to your balance.
  8. Before any withdrawals are processed, Your play will be reviewed for any breach of the Terms and Responsible Gaming checks. Should We deem that a breach has occurred, or You have another account which is restricted due to our Responsible gaming tools/procedures, We reserve the right to only pay out that which remains of the deposits made by You. Any contact by Us congratulating any win does not mean the win is legitimate and that the Accounts Department have checked for breaches of the Terms.
  9. In the event that You fail to comply with any of Our requests to provide KYC documents, We reserve the right to reverse the withdrawal back into your account pending investigation.
  10. Withdrawal requests are only deemed valid if they are submitted via the withdrawal page in the casino software. We do not accept withdrawal requests via email or telephone, or any other method.
  11. There is no minimum amount for withdrawal.

 

9. Malfunctions

  1. If a technical problem/mis-configuration causes a game/feature/promotion to pay out (or a display issue causes wrong result to be displayed) a higher amount than should be paid (a game win, bonus game win, jackpot win etc) to a Player's account, We reserve the right to remove the relevant funds (or not pay the incorrectly displayed amount), cancel promotions/reward offers from the account that were incorrectly credited as well as any winnings subsequently won by using the incorrectly credited funds.
  2. If We detect a Player has or is abusing a technical glitch related to the games, Software or our services in any way, either on his own or in association with partners, We reserve the right to void any winnings, close the relevant Player/s accounts and only pay out that which remains of the deposits made by You. If we close Your account, we will inform You in writing thereof and of the reasons for the decision.
  3. In the event of a system malfunction all wagers shall be void.
  4. In the event a game is started but miscarries because of a failure of the system, We shall refund the amount wagered in the game to You by crediting it to the Your account or, if the account no longer exists, by paying it to You in an approved manner.
  5. If a game is interrupted, we shall ensure that it is possible to finish playing the game, unless otherwise specified in the Game Rules.
  6. If an interrupted game is not finished within 90 days, it must be terminated. The Game Rules will clearly state what will happen to your bet if a game is terminated before being finished.

 

10. Services Suspension

  1. We may temporarily suspend the whole or any part of the services for any reason at Our sole discretion. We may, but shall not be obliged to, give you as much notice as is reasonably practicable of such suspension. We will restore the Service, as soon as is reasonably practicable, after such temporary suspension.

 11. Change

  1. We reserve the right to suspend, modify, remove or add content to the Site or the services offered via the Site at Our sole discretion with immediate effect and without notice.
  2. We reserve the right to unilaterally update or amend this Agreement at any time and which may reasonably be required from time to time. You will be notified of any amendment to this Agreement via a prominent and explicit notification on the Site and/or via Your e-mail address supplied by means of an appropriate message. You hereby acknowledge and agree that continued use of our services on the Site constitutes ongoing acceptance of this Agreement. Notwithstanding the foregoing, You can terminate Your Account and withdraw Your available funds, if you, due to any possible amendment, no longer wish to continue using Our services.

 

12. Currencies

  1. The only currency that is available for depositing, withdrawing and playing is EUR.

 

13. Artificial Intelligence Software

  1. You agree not to use any AI software while using the Software and/or Site. We will act to detect and prevent the use of any AI software programs that enables You to have an unfair advantage over other players, including, but not limited to, detecting the running of such programs on your computer. In the event that we detect the use of AI software, and at Our sole discretion deem the detection to be valid, Your account will be terminated and all winnings cancelled.

 

14. Random Number Generator

  1. You accept and agree that an independent and certified random number generator will determine the randomly generated events required in connection with the services and where the result shown on the Software (as installed and operated by your hardware) conflicts with the result shown on Our, or Our game partners servers, the result shown on Our server shall in all circumstances take precedence.

 

15. Abusive or Offensive Language

  1. We will not tolerate any abusive or offensive language or other behaviour considered inappropriate by Us at Our sole discretion.
  2. Bad behaviour or language identified by Us or brought to Our attention may result in a suspension or loss of playing privileges or such other action as may be decided by Us, including, but not limited to, account termination. If We terminate Your account, We will inform You in writing thereof and of the reasons for the decision.
  3. It is forbidden for players to use offensive usernames or screennames when they register or login.
  4. Players may, at any time, submit information regarding abuse or other offences to Our customer support department for Us to investigate.

 

16. Monitoring of the Site

  1. Subject to applicable data protection laws, We may electronically monitor the Site and the players of the Site at any time in order to ensure compliance with this Agreement and may disclose any information, record or electronic communication of a player of the Site: (a) in compliance with any law, regulation or lawful governmental request; (b) if such disclosure is necessary for the continued operation of the Site; or (c) to protect Our rights and/or property of Our partners.

 

17. Inactive Accounts

  1. If an Account Holder does not log in to his Account for a period of 180 days, his Account will be considered an ‘Inactive Account’, We will remove 50 SEK from the Account as an administration fee each month whilst the Account remains Inactive. The monthly administrative fee is subject to change. If the Account has less than 5 EUR the entire amount will be removed and the balance will be zero. Once the balance reaches zero no more Inactivity Fees will apply.
  2. Players may recover funds from their inactive accounts by logging in and making a withdrawal request. In case of blocked and excluded accounts, players will need to contact Customer Support to recover funds.

 

18. Incomplete Games

  1. If you lose internet connection or abandon a game before it is complete (for example during a special mode in Slots, or during a hand in single player Blackjack) You will be able to complete the game by logging back in and opening the relevant game. If You do not do this within 90 days the game will be terminated and any bet You made will not be returned.

 

19. Customer Support

21. Customer Complaints

The Customer Support Department will acknowledge Your complaint within 72 hours of receipt and record at least Your contact details, the date of receipt of Your complaint and the subject matter and content of Your compliant. Our Customer Support Department will deal with Your complaint as soon as possible but in any event within eight (8) weeks.
  3. Please note, however, that Our Customer Support Department is not obliged to deal with a complaint if it relates to conduct about which You have previously submitted a complaint, and which has been settled in accordance with Our complaint handling procedures. In such a case, meaning Your complaint has not been accepted for handling, You will be informed accordingly within one (1) week of Our Customer Support Department receiving the respective complaint. If, however, Your complaint is accepted and settled accordingly, Our Customer Support Department will register the period within which Your complaint was settled, the manner in which Your complaint was settled and the outcome of Your complaint. 22. Affiliations or Interest of Directors, Management and Employees

  1. Our employees, managers, directors, agents or consultants and their relatives (including spouse, parent, partner, child or sibling) are not permitted to register or to participate directly or indirectly in any of the Games.

 

23. Copyright

  1. The Site and all of its content are protected by copyright, other intellectual property rights and equivalent rights including, but not limited to, text, trade or service marks, graphics, animations, videos, music, audio, logos, icons, images, know-how and trade secrets ('Copyright Material'). We are the sole owner of these Copyright Materials.

25. Notices

  1. Any notice we give to You will be sent to the email address that You provided when You registered your account. It is your sole responsibility to keep your email address updated and active.
  2. Unless otherwise specified herein, such notices or other communications shall be deemed received (a) on the date delivered, if sent by email, and (b) five business days after being sent, if sent by registered or certified mail.
  3. Each of the Parties hereto shall be entitled to specify a different address by giving notice as aforesaid to the other Party.
  4. Any notice You give to Us is recommended to be sent to the Customer Support department email address at support@luckyvegas.com. An email You send which is a reply to a transactional email (eg, deposit confirmation email, bonus confirmation email) is not an accepted form of contact and is not deemed to have been received by Us.

 

26. Governing Law

  1. Any dispute arising in respect of, or in connection with, this Agreement, its interpretation, execution, performance, or the Parties and their relationship, shall be governed and determined exclusively in accordance with the laws of the Netherlands, and the courts of the Netherlands shall have sole jurisdiction.

 

27. Limitation of Liability

  1. Except in cases of willful intent or gross negligence on Our part, We shall not be held liable for any damages or losses which may arise out of or in connection to any downtime, server or other technical disruptions which might arise in operation or transmission, the Site or its content or any misuse of the same or of the services offered via the Site, any errors or omissions in content, loss or corruption of data, communication or lines failure, unless such loss or damage arises whilst you are benefiting from Our services and such loss or damage arose due to a failure in Our systems. An interrupted game or other errors and faults will not negatively affect Your account or game balance.
  2. Except in cases of willful intent or gross negligence on Our part, Our total aggregate liability shall not exceed the amount of the wagers You placed via Your account in respect of the wager that gave rise to the relevant liability or the actual amount misplaced in Your account where such amount has been misplaced by Us due to a system failure, whichever the case may be.     
  3. We shall not be liable to You or any third party, except in cases arising from fraud, fraudulent misrepresentation, willful intent or gross negligence on Our part, for any contract, tort, negligence, or otherwise, for any loss or damage whatsoever arising from save as expressly provided in this clause 29, or in any way connected with, Your account, or any third parties, whether direct or indirect, incidental, special or exemplary damages (including, but not limited to, any damages, loss of business profits [including loss of, or failure to receive, anticipated winnings], business interruption, loss of business information, loss of data, loss of goodwill or reputation or any other loss) arising out of, or in connection with, use of the Site or of the services offered via the Site.
  4. Subject to clauses 29.1 and 29.4, such limitation of liability shall apply whether the damages arise from, but not limited to, use or misuse of, and reliance on, the services, inability to use the services, any non-compatibility between the Software and Player software or hardware, or any damages caused by or as result of the software, or from the interruption, suspension, or termination of the service (including such damages incurred by third parties), or termination of Player Account, to the fullest extent permitted by law.
  5. Our liability shall not be limited or excluded for:
    1. death or personal injury caused by Our negligence;
    2. fraud or fraudulent misrepresentation caused by Us;
    3. gross negligence from Our part or
    4. any other liability which cannot be excluded or limited under the applicable law.

 

28. Indemnifications

  1. Subject to clause 29, you agree to hold harmless and indemnify Us from and against any third party claim, including any liability or expense arising from claims, losses, actual damages, suits, judgements, litigation costs and reasonable legal costs, arising from fraud or fraudulent misrepresentation or gross negligence caused by you in your use of the services.

 

29. Entire Agreement, Modifications and Amendments

  1. This Agreement constitutes the entire agreement between the Parties with respect to the subject matter contained herein and supersedes all previous and contemporaneous agreements, proposals and communications, written or oral, between Us and You.

 

30. Severability

  1. If any provision of this Agreement is found or declared to be invalid or unenforceable by any court or other competent authority having jurisdiction, such finding or declaration shall not invalidate any other provision hereof, and this Agreement shall thereafter continue in full force and effect.

 

31. Segregated Funds

  1. All players’ funds will be kept in a separate bank account from Our ongoing business funds and the players’ funds will be protected from third parties’ claims even in the event of insolvency. The credit institution is aware of the requirement to separate the players’ funds from that of our ongoing business funds and will not to attempt to enforce or execute any charge, write-off, set-off or other claim against the players’ funds account, or combine the players’ funds with any other bank account in respect of any debt of Ours.

 

32. Jackpots

  1. All jackpot amounts displayed on the casino Site or within the casino Lobby are for information purposes only. The amount, conditions and whether the jackpot are included in the pay-out percentage is displayed within the relevant game window once the game has been launched.
  2. When a jackpot is won it is immediately reset on the server. This happens in real time however the display can sometimes only reset after a short display. Regardless of the Jackpot amount displayed in the game, the server-side Jackpot amount at the time of the win is the award which will be honored.
  3. Any jackpot payout greater or equal to €50,000 may require an extra 14 days for processing. 

 

33. Prohibited Practices

  1. Prohibited Practices are not permitted and will constitute a material breach of this Agreement. We will take all reasonable steps to prevent and detect Prohibited Practices and to identify the relevant players concerned if they occur. Subject to the above, however, We will not be liable for any loss or damage which You may incur as a result of any Prohibited Practices.
  2. You agree that You shall not participate in or be connected with any form of Prohibited Practice.
  3. We reserve the right, in respect of Your account (and/or any other account held by You with an intra-group company of Skill On Net) to terminate Your account and only pay out that which remains of your deposited funds, if:
    1. If We have reasonable grounds to believe that You have participated in or have been connected with any form of Prohibited Practice (either detected by us or by our gaming partners and our other suppliers) of any fraud, cheating and collusion practices which are used in the gambling and gaming industry (including but not limited to "Wonging", “Perfect Pair” Card Counting, Dragon Tiger "Suited Tie" Card Counting or any other Card Counting techniques); or
    2. If You have placed bets and/or played online games with any other online provider of gambling services and are suspected (as a result of such play) of any equivalent to any Prohibited Practice on those other gambling services, or other improper activity.
